Hi all,
Felt it was worth responding to this - thanks to those who forwarded it.
Just a few points of clarification:
1. This article is not being removed. The reporting in it is fair and accurate, backed up by ample documentary evidence. We have also collected scores of testimonies from candidates and companies outraged by ConSol Partners' behaviour.
Never in my journalistic career have I seen such systematically unethical behaviour deployed as a matter of routine, nor been so angry on behalf of the many people who wrote in to us after publication at the stories of lost wages, wasted time and broken faith for which ConSol Partners has been wholly responsible.
2. Consol Partners has threatened legal action against us but they have to date not taken any. We have had a letter from their lawyers, as is often the case when wrongdoers get busted, but that's it. Neither I nor the writer of the second article we published about ConSol has been sued, nor are either of us under "criminal investigation". That's a serious allegation which is itself actionable.
Lauren, I realise that deceit is Consol Partners' modus operandi but I would caution you very strongly against any more lies left on public forums or on community mailing lists. ConSol's already atrocious reputation is not well served by them. Should your CEO follow through with his threat to sue us (I very much doubt the suit, like all the other ones he likes to threaten, will materialise) I relish the prospect of vigorously defending our journalism in court.
For the benefit of this list, please find below our correspondence with Consol Partners' lawyers. I'll let the community make up its own mind who is telling the truth here.
Apologies for the long email but I felt I ought to set the record straight.
All the best,
Milo
Dear Sir,
WITHOUT PREJUDICE
We strenuously deny your client's allegations of defamation and malicious falsehood. We are in possession of ample documentary evidence that ConSol Partners has acted in the manner alleged in our articles and we consider this case of sufficient public interest to vigorously defend the integrity of our journalism. We have reviewed the contents of our articles and we are satisfied that our claims are true, provable and published in the public interest. We stand by our sources and our reporting.
We also of course deny any accusation of malice, which is an absurd claim. There is no reason why The Kernel would have any sort of vendetta against ConSol Partners. In fact, I have personally offered Mr Cohen interviews on more than one occasion that would give him the opportunity to address questions raised by our reporting, going well above and beyond the established standard of right of reply. Mr Cohen has declined to avail himself of these opportunities to defend his and his company's practices.
We would like to remind your client that the success of libel actions rests on the claimant having a good name to lose. We submit that based on our extensive research and reporting on the recruitment industry over the last eighteen months that this is simply not the case. Mr Cohen will be perfectly well aware why.
We have taken the decision today that given the overriding public interest in this case, which was the sole reason for our coverage in the first place, we will publish all correspondence, proceedings and documentary evidence on our website and crowdfund a legal defence fund to enable others who have felt wronged by your client to contribute to our efforts to show that using fraudulent identities and lying to candidates and employers is not acceptable business practice in the recruitment industry, should the matter go further.
Initial enquiries on our behalf show that several technology businesses, furious at the behaviour of your client and his employees, would be enthusiastic about contributing to such a fund and in assisting us in publicising our defence, as would the candidate whose horrific experience with Mr Cohen's company, leaked to us last year, was the motivating factor behind our and our readers' interest in ConSol Partners.
In your letter you complain about allegations made on Twitter of email hacking. Until such time as our contributor James Cook has evidence enough to publish these accusations he retracts them. I have asked him to delete the relevant tweets and he has agreed to do so.
Should your client decide to launch proceedings we will refer you to our representatives at Reed Smith for further correspondence.
Yours faithfully,
Milo Yiannopoulos
Publisher, The Kernel
For and on behalf of the directors of Sentinel Media Ltd.

This is off the back of a lot of rogue journalism coupled with the fact that we also took legal action against the publisher. The writer involved is also facing criminal prosecution. The article is totally inaccurate, malicious and unfounded.

I understand that successful and growing companies are often subjected to articles and taunts such as these. Most of the people reading this will know others like to knock competitors or companies gaining success.

For this reason we have repeat business year on year, have worked closely with the same network of candidates for many years, have great staff retention and received industry recognition off the back of our work.
